Annotatsiya

Maqolada jamoatchilik fikrini oʻrganishga oid Oʻzbekiston qonunchilik hujjatlari, amaliyoti, xalqaro standartlar va xorijiy tajriba tadqiq etildi. Tadqiqotning maqsadi ushbu jarayonning huquqiy asoslarini takomillashtirish va mavjud kamchiliklarni bartaraf etishdir. Tadqiqot jarayonida milliy qonunchilikda belgilangan “jamoatchilik fikrini oʻrganish” tushunchasi takomillashtirishga muhtoj ekanligi va tartibi ishlab chiqilmaganligi, uning shakllari ilmiy muloqotda mavjud emasligi, vositalari oʻz ma’nosiga mos kelmasligi va boshqa muammolar aniqlangan. Jamoatchilik fikri va uni oʻrganish toʻgʻrisidagi qarashlar, amaliyot va qonunchilik hujjatlari: tahlil, funksional, tuzilmaviy, qiyosiy, rasmiy yuridik va boshqa usullar vositasida tadqiq etildi. Natijada jamoatchilik fikri va uni oʻrganish mazmuni ochib berildi; milliy qonunchilikda ushbu jarayonning umumiy qoidalari, jumladan, uning sifati va xolisligini baholash uchun e’lon qilinishi shart boʻlgan ma’lumotlarni belgilash, oʻrganish natijalarini referendumda ovoz berish va u boshlanishidan bir kun oldin e’lon qilishni taqiqlash zarurati asoslandi. Muallif jamoatchilik fikrini oʻrganishning uslubiy tavsiyalarini Oʻzbekiston sotsiologlari assotsiatsiyasi va Markaziy saylov komissiyasi, mazkur tavsiyalar va bu boradagi huquqiy me’yorlar ijrosi ustidan nazoratni saylov komissiyalari zimmasiga yuklash taklifini ilgari surgan.
