MECHANISMS FOR ENSURING THE RIGHTS OF SUSPECTS AND ACCUSED PERSONS IN CRIMINAL PROCEEDINGS

The article examines the main mechanisms for ensuring the rights of suspects and accused persons in criminal proceedings. The author analyzes the current procedural guarantees and the role of the advocate in their implementation, as well as the problems arising at the stage of preliminary investigation. Special attention was paid to the practice of applying the norms of the legislation of the Republic of Uzbekistan and international standards for the protection of human rights. Based on a comparative legal analysis, directions for improving national legislation aimed at increasing the effectiveness of protecting individual rights in criminal proceedings have been proposed. In turn, this study emphasizes that the effectiveness of the realization of the rights of the suspect and the accused largely depends not only on the formal consolidation of procedural norms but also on the practice of their application by law enforcement agencies. The analysis of the procedural status of the suspect and the accused in the context of ensuring the balance between the interests of the state and the rights of the individual deserves special attention.
