Unfair competition – unfair trade practices: the concept and characteristics

Abstract

 In the conditions of rapidly developing market relations unfair competition and its prevention is one of the most important economic problems today. Therefore, in the sphere of regulation of economic relations the state carries out systematic legal reforms aimed at further improving the legislative system related to the protection of citizens from any unlawful actions. However, where there is competition, there can always be unfair competition prohibited by law.  Unfair trade practices are as much a crime as unfair competition. Unfair competition, in particular unfair trade practices, can be applied in the form of various violations in the field of protection of competitors and consumer rights and regulated through legal regulation of different areas of law, in particular the Intellectual Property law and the Competition law. The author of the article analyzes the concept and characteristics of unfair competition, the concept and characteristics of unfair trade practices in terms of legal doctrine, international law and the Law of the Republic of Uzbekistan “On Competition”, seeks to address a number of priorities, issues associated with the improvement of legislation by reflecting in the relevant legislation.
