THE CONCEPT OF NOTARIAL PROCESS AND ITS CHARACTERISTIC FEATURES

Abstract

In this scientific article, the subject of research is the concept of the notarial process and its characteristic constituent elements, signs and features. Considering the multidisciplinary activities of notaries and the versatility of their work, the scientific article pays special attention to modern trends in the notarial process, namely digitalization, strengthening of electronic notarial document flow, and preference for completing the majority of notarial transactions in a remote format, as the most promising direction for optimizing the notarial process. Playing a key role in maintaining legal stability and preventing legal disputes, their practice provides access to legal services to a wide range of citizens and organizations, simplifying legal processes. The purpose of the research in this scientific article is a brief study of the concept, features, and characteristic features of the notarial process as a practical component of the notary as a whole. The relevance of studying the meaning and concept of the modern notarial process is due to the fact that notarial documents today protect the interests of the parties and increase confidence in transactions and agreements. The methodology consists of research methods, in particular, the scientific article used such methods as dialectical, analysis, synthesis, induction, deduction, generalization, modeling, and forecasting. The results of the study are conclusions and general methodological proposals for updating the notarial process in order to improve and optimize it. These areas should be of a strategic and programmatic nature, implemented at a constant level, since the constant work of notaries can be effectively implemented through smart technologies and approaches to their use.
