ISSUES OF REFLECTION OF THE PURPOSE OF REMOVING HUMAN ORGANS AND TISSUES AS AN AGGRAVATING ELEMENT OF THE CRIME

The article analyzes issues regarding the criminal law assessment of the intent to remove human organs and tissues as an aggravating characteristic of the crime. It examines the strengthening of this goal as a qualification feature in Articles 97, 104, 135, and 137 of the Criminal Code of the Republic of Uzbekistan, as well as the essence of the legislative amendments introduced in 2022. At the same time, based on the decisions of the Plenum of the Supreme Court, the subjective side of the crime is highlighted, in particular, the significance of the purpose of obtaining human organs and tissues in the qualification of the crime. The article provides a comparative analysis of national legislation and the criminal legislation of foreign countries, examining the level of social danger of crimes involving human organs and certain problems in their qualification. Also, proposals have been put forward to provide for the purpose of obtaining human organs and tissues as an aggravating characteristic in other elements of crimes and to improve judicial practice.
