Abstract

The article examines the constitutional foundations of the right to qualified legal assistance in the Republic of Uzbekistan. The author addresses the problem of the lack of a legal definition of this concept in current legislation and examines controversial issues regarding the circle of persons authorized to provide legal assistance. Significant attention is paid to the distinction between the categories of “legal aid” and “legal services,” as well as the controversy surrounding the institution of “advocate monopoly.” Based on the analysis of the regulatory framework and the provisions of the legal doctrine, it is concluded that legal aid quality standards must be legally enshrined. Furthermore, the expediency of expanding the subject composition of persons providing such assistance by including private practitioner lawyers is substantiated, provided that appropriate regulatory mechanisms are established.
