LIABILITY FOR WAR CRIMES IN THE CONTEXT OF MODERN ARMED CONFLICTS: A NATIONAL AND INTERNATIONAL LEGAL ANALYSIS

This article analyzes the national and international legal foundations of criminal liability for war crimes in the context of modern armed conflicts. The study examines the interaction between international criminal law and national criminal legislation, the criminalization of war crimes, the inevitability of punishment, the principle of legality, universal jurisdiction, the non-application of statute of limitations, and the institutions of command responsibility. Additionally, international court decisions, doctrinal sources, and the role of national legal norms in law enforcement practice will be evaluated, and scientific and practical proposals will be put forward to improve the legislation of the Republic of Uzbekistan in accordance with international humanitarian law and international criminal law standards.
