Abstract

This article provides a comprehensive criminal-law analysis of the objective elements of socially dangerous acts committed with the involvement of artificial intelligence (AI). Drawing on fundamental theories concerning the object of crime and the objective aspect of a criminal offence, the study considers AI technologies not as independent subjects of crime, but as intelligent instruments of criminal activity that may pose a heightened degree of social danger. The article provides a legal justification for the view that civil liability alone, including liability based on the concept of a source of increased danger, is insufficient to address harm caused through AI. It also examines current trends in cybercrime in Uzbekistan from a criminological perspective, including cyber theft, deepfake fraud, virtual financial pyramid schemes, and the phenomenon of “droppers.”Based on the analysis, the author puts forward academically grounded proposals for improving the Criminal Code of the Republic of Uzbekistan by introducing special provisions on criminal liability for offences committed using AI, including rules addressing the stage of preparation for crimes committed in the digital environment.
