THE CONCEPT OF TYPES OF CIVIL PROCEEDINGS AND SOME SOME CONSIDERATIONS ON THEIR IMPROVEMENT

Abstract

This article provides a scientific and theoretical analysis of the problems of improving the concept, types, and forms of civil proceedings. In particular, the views of legal scholars on the concept of types of civil proceedings are considered and analyzed. In addition, the procedure for considering and resolving cases related to various types of civil proceedings, including order proceedings, claim proceedings, proceedings in cases of special proceedings, as well as the recognition and enforcement of decisions of foreign courts and foreign arbitration courts, including decisions of foreign arbitration courts, has been studied. In the article, the opinions of domestic and foreign legal scholars are analyzed from a scientific and theoretical point of view, and the norms of civil procedural legislation of foreign countries are comparatively studied. Based on the analysis conducted, scientific and theoretical conclusions, proposals, and recommendations were formulated.
