НЕКОТОРЫЕ АСПЕКТЫ РАСПРЕДЕЛЕНИЯ ОБЯЗАННОСТЕЙ ОРГАНОВ ПРОКУРАТУРЫ ПО ОСУЩЕСТВЛЕНИЮ НАДЗОРА ЗА ИСПОЛНЕНИЕМ ЗЕМЕЛЬНОГО ЗАКОНОДАТЕЛЬСТВА

Настоящая статья посвящена анализу сферы деятельности органов прокуратуры, уполномоченных осуществлять контроль за исполнением земельного законодательства, некоторые вопросы взаимного распределения обязанностей между ними, вопросы, связанные с регулированием земельных отношений в зарубежных странах, задачи и полномочия иностранных органов прокуратуры в земельной сфере, и включает предложения по совершенствованию законодательства. В частности, некоторые аспекты организации соответствующих подразделений Генеральной прокуратуры и территориальных прокуратур, которые отвечают за осуществление надзора за исполнением земельного законодательства, совершенствования их деятельности и деятельности специализированных прокуратур, организованных для природоохраны, также проанализированы случаи присвоения функции надзора за реализацией земельного законодательства. Кроме того, представлены статистические данные по изучаемому вопросу, научные взгляды ученых-исследователей и мнения специалистов, а также уделено внимание теоретическим аспектам анализируемого предмета. В результате изучения опыта в области контроля за исполнением законодательства в сфере землепользования в зарубежных странах, конкретно стран Запада, сделан вывод, что основная деятельность органов прокуратуры направлена на обеспечение участия прокурора в судебных процессах и реализацию государственной политики в сфере борьбы с преступлениями, а в странах СНГ функция прокурорского надзора является доминирующей.
