O‘ZBEKISTONDA AYOLLARGA NISBATAN KIBERTA’QIB: AMALDAGI QONUNCHILIK VA ISLOHOTLAR ISTIQBOLI

Maqola Oʻzbekiston amaldagi qonunchiligining ayollarga nisbatan tizimli ravishda amalga oshiriladigan raqamli taʼqibni mustaqil huquqiy hodisa sifatida kvalifikatsiya qilish imkoniyatlarini baholashga bagʻishlangan. Tadqiqotning dolzarbligi mamlakat raqamlashuvi jadal surʼatlar bilan rivojlanayotgan sharoitda ushbu sohadagi maxsus huquqiy tartibga solish mexanizmlari mavjud emasligi bilan belgilanadi. Maʼmuriy javobgarlik toʻgʻrisidagi kodeks va Jinoyat kodeksining tegishli normalarini doktrinal tahlil qilish, shuningdek, Qozogʻiston, Buyuk Britaniya va Janubiy Koreya qonunchiligini qiyosiy-huquqiy tahlil qilish asosida toʻrtta tizimli boʻshliq aniqlangan. Bular: taʼqib uchun mustaqil jinoyat tarkibining yoʻqligi, amaldagi normalarning gender jihatdan betarafligi, raqamli muhitda himoya orderlari imkoniyati cheklanganligi va provayderlar javobgarligi mexanizmi mavjud emasligidir. Tadqiqot natijalari Oʻzbekiston Respublikasi Prezidentining 2026-yildagi PF–33-sonli farmoni ijrosi doirasida qonunchilik takliflari ishlab chiqishda qoʻllanishi mumkin. Muallif tomonidan toʻrt komponentli islohotlar strategiyasi: zoʻravonlikka qarshi kurashish boʻyicha milliy strategiya, sohaga oid qonunda texnologiya orqali amalga oshiriladigan gender zoʻravonlikni konseptual tan olish, mustaqil jinoyat-huquqiy tarkibni belgilash va jabrdiydalarni qoʻllab-quvvatlashning institutsional infratuzilmasini yaratish taklif etilmoqda.
