LEGAL SUBJECT OF MINORS IN THE ALTERNATIVE GUARDIANCE SYSTEM

The article is devoted to the theoretical and legal analysis of the legal personality of minors in the system of alternative guardianship in the legislation of the Republic of Uzbekistan. The author examines the structure and content of legal personality, including legal capacity, legal capacity, and criminal capacity, as well as the role of legal representatives, issues of property rights, and the influence of international standards. The scientific novelty of the research is manifested in the conceptualization of the legal personality of minors as a hybrid construction, as well as in the identification of internal contradictions related to the legal status and functions of legal representatives. Based on the results of the analysis, recommendations were formulated for improving the institution of guardianship, aimed at ensuring the best interests of the child.
