Abstract

Statements of the positive and negative aspects of diverting juveniles from the formal justice system may not be convincing unless there is a clear definition of what diversion measures are, both in terms of the etymological meaning of the word and from the point of view international standard and its effectiveness. In the literature, diversion measures are not translated precisely from English into Russian. For example, words, such as “deduction,” “avoidance,” “withdrawal,” “diversion,” “divergence” have similar meaning in English. However, the author does not apply a legal-linguistic approach to research to reflect the essence and effectiveness at the same time. He examines various approaches to understanding the measures of diversion of juveniles from criminal justice and their significance, analyzes foreign literature, and summarizes the results of a comparative analysis of theories and concepts on diversion measures. In conclusion, the author concludes that it is necessary to continue studying the various concepts and practices of this institution for its further effective and harmonious implementation in Uzbekistan, taking into account the national specifics and best foreign practices.
