Abstract

This article analyzes the formation, content, and main problems of transnational insolvency. As a result of globalization and the expansion of international economic relations, the involvement of several countries in bankruptcy processes is becoming increasingly common. The article highlights the theories of universalism and territoriality, their advantages and disadvantages, as well as the importance of cooperation and coordination between states. Legal standards and modern approaches developed by international organizations will be analyzed separately. The results of the study are of scientific and practical importance in improving the law of transnational insolvency, adapting national legislation to international standards, and developing effective legal mechanisms in practice.
