SOCIAL DANGER OF VIOLATION OF SAFETY RULES FOR TRANSPORT VEHICLE MOVEMENT OR OPERATION AND ITS SIGNIFICANCE IN ESTABLISHING CRIMINAL LIABILITY

In this article, the formation of social relations, the historical stages of legal regulation in this field, and the characteristics of social danger of this crime are analyzed in detail. In the study, international legal documents related to ensuring the safety of vehicle traffic, in particular, UN conventions, the experience of foreign countries and national legal norms were comparatively studied. The article describes the growth dynamics of traffic accidents, their negative consequences for human life and health, public safety, state and public interests, based on statistical data. Also, the theoretical views of national and foreign scientists on the issue of social danger of violating the rules of the industry were analyzed, and the objective and subjective factors determining the level and characteristics of social danger of the crime were scientifically substantiated. The legal and social necessity of the criminalization of this act has been revealed, and it has been proven that ensuring road traffic safety is one of the important tasks of the state. At the same time, special attention is paid to the issues of differentiating the acts committed with the intentional use of the vehicle for criminal purposes from the crimes of recklessly violating the rules of transport safety. At the end of the article, scientific conclusions and practical proposals aimed at eliminating existing problems in the field of road safety, strengthening crime prevention, improving legal mechanisms and protecting the life and health of citizens are put forward.
