MECHANISMS FOR ENSURING THE INEVITABILITY OF PUNISHMENT FOR HUMAN TRAFFICKING

Abstract

This article provides a theoretical and practical analysis of mechanisms for ensuring the inevitability of punishment for the crime of human trafficking. Human trafficking is one of the most serious transnational crimes against human rights and freedoms, and ensuring the inevitability of punishment is of particular importance in the fight against it. The primary objective of the article is to identify effective legal and institutional mechanisms guaranteeing the inevitability of liability for this crime and to develop scientifically grounded proposals for their improvement. In the course of the study, criminal law norms, investigative and judicial practice, as well as the system of preventive measures, were comprehensively studied. In particular, the level of detection and solving of crimes, mechanisms for collecting and evaluating evidence, the victim protection system, and the level of cooperation between competent authorities were analyzed as important factors in ensuring the inevitability of punishment. At the same time, problems encountered in law enforcement practice are scientifically substantiated, including the concealment of crimes, difficulties in proving, jurisdiction issues arising from transnational characteristics, and in some cases, cases of evading responsibility. The article provides a comparative analysis of advanced mechanisms for ensuring the inevitability of punishment based on foreign experience and international legal standards. At the end of the study, specific proposals and recommendations were put forward aimed at increasing the effectiveness of the fight against human trafficking, timely detection of crimes and ensuring fair punishment. These results are of great scientific and practical importance in improving criminal legislation and developing law enforcement practice.
