Abstract

The article analyses the theoretical, legal, and practical significance of monitoring the implementation of regulatory legal acts for identifying gaps in legislation. It examines the concept of a legislative gap and distinguishes it from legal conflicts, errors in legislative drafting, and ineffective legal provisions. Monitoring is considered as a means of identifying the need for legal regulation, comparing the objectives of regulatory legal acts with their practical outcomes, and detecting problems arising in law-enforcement practice. The article substantiates the need for the combined use of formal legal and concrete sociological methods in identifying gaps in legislation. The current legislation of the Republic of Uzbekistan is analysed, with particular attention to the new model for monitoring the implementation of regulatory legal acts introduced in 2025. To improve the effectiveness of monitoring, the article proposes establishing criteria for selecting the objects of monitoring, expanding public participation, ensuring the public disclosure of monitoring results, introducing digital analysis of judicial practice and public appeals, and strengthening the legal consequences of monitoring reports.
