SCIENTIFIC APPROACHES TO THE OBJECTIVE SIGNS OF SEXUAL CRIMES

This article analyzes scientific approaches to the objective signs of sexual crimes. In addition, the article presents the opinions of scientists on the fact that sexual crimes are directed against the individual, encroaching on sexual freedom and inviolability, one of the most dangerous crimes for society, and its social danger, and provides relevant suggestions and recommendations. In the process of analyzing the article, the author also examines the opinions of lawyers who recognize the normal sexual development of a person as the object of sexual crimes and gives their opinions and judgments. In this article, the author also touched upon the characteristics and aspects that distinguish between Articles 118 and 119 of the Criminal Code of the Republic of Uzbekistan. At the same time, the article analyzes and expresses the author’s opinion that aggression against a person’s sexual development is linked not only to physical consequences, but also, first and foremost, to psychological and social danger. The article also examines types of violence in the commission of a sexual crime and actions taken by the perpetrator to break the victim’s resistance and to prevent resistance that does not yet exist.
