ГРАЖДАНСКО-ПРАВОВЫЕ ВОПРОСЫ ОБРАЩЕНИЯ КРИПТОВАЛЮТ В СФЕРЕ ЦИФРОВЫХ ФИНАНСОВЫХ УСЛУГ

В результате глобализации мирового сообщества права и обязанности хозяйствующих субъектов гарантированно регулируются международными договорами, конвенциями, а также коллизионными нормами, существующими в национальном законодательстве. На сегодняшний день предоставление современных технологических средств и молниеносное развитие цифровой деятельности ставит на повестку дня проведение исследований по решению вопроса, связанного с правами участников отношений в этой области. В свою очередь важно учитывать законы и нормативные акты, направленные на регулирование этой сферы, ряда развитых стран, которые продвинулись в области цифровых финансовых услуг. В данной статье рассматриваются вопросы отчуждения цифровых финансовых активов как объектов гражданских правоотношений, выходя за рамки общепринятых традиционных подходов. В частности, мир интересует вопрос о том, как регулировать права и обязанности, возникающие при торговле или обмене криптовалют между пользователями через Интернет. Данная ситуация требует правового обеспечения движения и использования криптовалют в финансовых операциях между физическими лицами. Криптовалюты вызывают много юридических вопросов. Актуальность исследования определяют такие вопросы, как: насколько эти валюты регламентированы с точки зрения законодательства или качества их использования, а также необходимость контроля финансовых операций с криптовалютами с точки зрения права.
