ЮРИДИЧЕСКОЕ ПРЕДСТАВИТЕЛЬСТВО В ГРАЖДАНСКИХ СУДАХ ПРИ РАЗРЕШЕНИИ СПОРОВ: СТАТУС, ОСНОВАНИЯ И ПРОЦЕДУРА

В данной статье анализируются вопросы участия законного представителя в гражданском процессе, основы юридического представительства и порядок участия в деле, обязательное участие законного представителя на стадии рассмотрения дела в суде. Были изучены преимущества практического опыта развитых зарубежных стран по совершенствованию деятельности юридического представительства в гражданско-процессуальном законодательстве. Данная статья как доктринальное исследование содержит анализ законодательных актов и научно-теоретических источников. В ней изучаются научные концепции отрасли, взгляды, выводы и мнения ученых-теоретиков. Также проведен сравнительно-правовой анализ законодательства в сфере института представительства. Целью нашего исследования является правовой анализ института законного представительства при разрешении споров в гражданских судах. Посредством данной статьи анализируются вопросы участия законного представителя в гражданском процессуальном законодательстве на сегодняшний день, основания законного представительства и порядок участия в деле, обязательное участие законного представителя на стадии рассмотрения дела в суде. Изучаются преимущества изучения практического опыта развитых зарубежных стран по совершенствованию деятельности законного представительства в гражданском процессуальном законодательстве. Также были внесены предложения и рекомендaции по совершенствованию деятельности юридического представительства и законодательства.
