THE PHENOMENON OF LEGAL GAPS AND THEIR ELIMINATION: ON THE EXAMPLE OF UZBEKISTAN’S CIVIL LEGISLATION

The article provides a comprehensive theoretical and practical analysis of the phenomenon of legal gaps and the mechanisms for their elimination. Legal gaps are examined as an objective and complex phenomenon arising in the process of development of the legal system, and the forms of their manifestation in civil legislation are revealed.The purpose of the article is to substantiate the criteria for identifying and classifying legal gaps, to conduct a comparative analysis of approaches developed in national and foreign legal doctrine, and to elaborate specific legal mechanisms for eliminating legal gaps using the example of the civil legislation of the Republic of Uzbekistan. The study employs methods of systemic analysis, comparative legal analysis, normative legal analysis, and doctrinal research. The views of national and foreign scholars on the issue of legal gaps are generalized, and legal gaps in civil legislation related to the protection of personal non-property rights, the inviolability of private life, the protection of image, and personal data are identified. The article proposes specific normative and institutional recommendations aimed at eliminating legal gaps, substantiates the necessity of strengthening legal monitoring, improving recodification processes, and introducing mechanisms for the early identification of legal gaps in lawmaking activities. The findings of the study may be used in lawmaking practice, in improving civil legislation, and in further scientific research.
