ТЕОРЕТИКО-МЕТОДОЛОГИЧЕСКИЕ ОСНОВЫ ЮРИДИЧЕСКОЙ ГЕРМЕНЕВТИКИ

В настоящей статье освещаются становление юридической герменевтики, её место в методологии юридической науки, а также этапы её исторического развития. На основе научных источников рассмотрены взгляды Гуго Гроция на толкование правовых текстов, их влияние на дальнейшее развитие герменевтики и значение в современной теории права. В статье проведён концептуальный анализ понятий герменевтики, юридической герменевтики и правового толкования. Кроме того, раскрыты необходимость толкования правовых норм с учётом требований современности и методологические функции герменевтики в правоприменительной практике. На основе принципа историзма последовательно проанализировано значение юридической герменевтики как метода. Представленные в исследовании теоретические положения могут быть использованы в научно-исследовательских работах по специальностям «Теория и история государства и права» и «История правовых учений».
