ТЕОРЕТИКО-ПРАВОВЫЕ ВОПРОСЫ СОВЕРШЕНСТВОВАНИЯ ОЦЕНКИ РЕГУЛЯТОРНОГО ВОЗДЕЙСТВИЯ И ПРАВОВОГО МОНИТОРИНГА

В данной статье анализируются вопросы совершенствования оценки регуляторного воздействия нормативно-правовых актов как элемента модели «умного регулирования» в Республике Узбекистан. В частности, автор исследует правовой мониторинг исполнения социально-экономически значимых нормативно-правовых актов на основе целевых показателей в тесной взаимосвязи с оценкой регуляторного воздействия. Также рассматриваются рекомендации ОЭСР по совершенствованию регулирования в стране. В качестве выводов автор предлагает, во-первых, конкретизировать на законодательном уровне понятие «социально-экономически значимые нормативно-правовые акты» (в новой редакции Концепции совершенствования нормотворческой деятельности), во-вторых, разработать меры по рациональному применению принципа соразмерности при проведении оценки регуляторного воздействия и правового мониторинга нормативно-правовых актов.
