КИБЕРВОЙНА И КИБЕРОПЕРАЦИИ В МЕЖДУНАРОДНОМ ПРАВЕ: ПРОБЛЕМЫ РАЗГРАНИЧЕНИЯ И ПРАВОВОГО РЕГУЛИРОВАНИЯ

Статья посвящена исследованию правовой природы кибератак, киберопераций и кибервойны в международном праве. Целью исследования является разграничение указанных понятий и анализ применимости норм международного гуманитарного права к действиям в киберпространстве. Методологическую основу исследования составили теоретико-догматический, сравнительно-правовой, эмпирический и статистический методы, включая анализ практических кейсов (Stuxnet, WannaCry, NotPetya, SolarWinds, кибероперации в рамках российско-украинского конфликта), а также данных международных аналитических центров. В результате исследования установлено, что киберпространство сформировалось как самостоятельная сфера конфликтного взаимодействия, однако существующие международно-правовые нормы регулируют отношения в данной области лишь частично, что обусловливает наличие правовых пробелов и так называемой «серой зоны».
