РЕГИОНАЛЬНЫЕ МЕХАНИЗМЫ И ПРОЦЕДУРЫ ОБЕСПЕЧЕНИЯ ПРАВА НА ОБРАЩЕНИЕ В МЕЖДУНАРОДНЫЕ ОРГАНЫ

В статье освещаются правовые основы и процедуры обращения в органы региональных организаций, специализирующиеся в области прав человека. Актуальность темы определяется закреплением указанного права в Конституции Республики Узбекистан в новой редакции и необходимостью выявления различий между механизмами его реализации на практике. Цель исследования заключается в сравнительной оценке полномочий общерегиональных, субрегиональных и трансрегиональных структур, условий приемлемости обращений и эффективности деятельности указанных структур. С применением сравнительно-правового, системного и институционально-функционального методов показано значение региональных механизмов в обеспечении права на обращение, раскрыты пределы их юрисдикции, особенности, общие черты и различия. Результаты исследования могут быть использованы для совершенствования национального законодательства в сфере организационно-правового обеспечения права на обращение в международные органы, а также для оценки перспектив формирования региональных систем защиты прав человека в Азии и Центральной Азии.
