MEHNAT SHARTNOMASINI TARAFLAR IXTIYORIGA BOG‘LIQ BO‘LMAGAN HOLATLAR BO‘YICHA BEKOR QILISHGA OID MDH DAVLATLARI MEHNAT QONUNCHILIGINING QIYOSIY-HUQUQIY TAHLILI

Mazkur maqolada mehnat shartnomasini taraflar ixtiyoriga bog‘liq bo‘lmagan holatlar bo‘yicha bekor qilishga oid MDH davlatlari mehnat qonunchiligi qiyosiy-huquqiy tahlil qilingan. MDH davlatlarining Mehnat kodekslarini ishlab chiqishda ularning iqtisodiyot modeliga e’tibor berilgan. O‘zbekiston Respublikasi Mehnat kodeksini ishlab chiqishda ham O‘zbekiston tomonidan tanlangan bosqichma-bosqich bozor iqtisodiyotiga o‘tishning “o‘zbek modeli”ning o‘rni alohida ahamiyatga ega bo‘lgan. MDH davlatlarining mehnat qonunchiligida xodimning yoki jismoniy shaxs bo‘lgan ish beruvchining vafot etishi, shuningdek, sud tomonidan xodimning yoki jismoniy shaxs bo‘lgan ish beruvchining vafot etgan yoki bedarak yo‘qolgan deb topilishi mehnat shartnomasini taraflar ixtiyoriga bog‘liq bo‘lmagan holatlar bo‘yicha bekor qilish mumkin. O‘zbekiston Respublikasining amaldagi Mehnat kodeksiga ko‘ra, faqatgina xodimning vafoti munosabati bilan mehnat shartnomasini ushbu asos bilan bekor qilish mumkin. Ayrim MDH davlatlarida lavozimga saylanmaslik (shu jumladan, tanlov asosida ham) mehnat shartnomasini taraflar ixtiyoriga bog‘liq bo‘lmagan holatlar bo‘yicha bekor qilish asosi hisoblanadi. Yangi muddatga saylanmagani (tanlov bo‘yicha o‘tmagani) yoxud saylanishda (tanlovda) qatnashishni rad etgani munosabati bilan mehnat shartnomasi O‘zbekiston Respublikasining amaldagi Mehnat kodeksining 97-moddasi oltinchi bandi bilan bekor qilinadi. Chunki ushbu holat mehnat shartnomasini bekor qilishning umumiy asoslaridan biri sanaladi.
