CONSTITUTIONAL AND LEGAL PROTECTION OF INTELLECTUAL PROPERTY AND ITS IMPORTANCE

Abstract

This article analyzes intellectual property, its constitutional protection and development trends in this regard in the world constitutionalism. The history of the dynamics of intellectual property rights development is also considered. According to the author, the state, since it establishes the protection of intellectual property by law at the constitutional level, assumes a number of obligations in this area. At the same time, views were expressed on how the modern process of globalization affects the national legislation of countries. Examples of issues to be studied scientifically and theoretically in the field of intellectual property law were given. Ways of intellectual property expression in constitutions and laws of foreign countries have been studied. Examples of approaches of legal scholars to this issue are given and the author’s position is stated. According to the author’s opinion, since in modern post-industrial society the economy is called “intellectual economy” or “knowledge economy”, any modern country should be able to feel the challenges of this. On this basis, the expression of the concept of “intellectual property” in the Constitution of the Republic of Uzbekistan can be assessed as a worthy response to these calls. In its turn, this intellectual property cannot but serve to stimulate tangible income from an intangible object. In particular, it can create grounds for increased attention to its commercialization.
