IMPROVING THE ANTI-CORRUPTION EXPERTISE OF PROJECTS FOR THE ADOPTION OF DIRECT-ACTION LAWS

Abstract

In the Republic of Uzbekistan, measures are being taken to strengthen the legislative process and adopt direct legal acts. The direct effect of the law as a form of exercising the right is the property of the legal norms enshrined in the law to have (without any acts specifying them) a direct regulatory effect on everyone to whom they are addressed, as well as the associated opportunity for citizens to demand protection (provision) of their rights, referring only to these provisions of the law. Unfortunately, the effective practice of adopting laws of direct effect is not effective, which is due to various reasons. This article critically analyzed the procedure and mechanism for conducting anti-corruption expertise of draft laws to ensure the adoption of laws of direct effect. The main purpose of the article is to analyze the criteria for evaluating the project during the examination. The statistical, comparative-legal method and the method of generalization of scientific research of scientists were used as research methods. Taking into account the analysis, it was revealed the need to comprehend the theoretical and practical foundations of the Institute of anti-corruption expertise in the Republic of Uzbekistan in order to improve the procedure for the adoption of laws of direct effect. Based on the results of the study, conclusions were drawn regarding the improvement of the effectiveness of anti-corruption expertise. These proposals can be used in the development of relevant draft regulations, strategic documents for the development and further reform of the Institute of anti-corruption expertise. The findings of the study can be used in lawmaking activities.
