Abstract

This article theoretically studies the issues related to individual appeals to the constitutional judicial bodies, and comparatively analyzes the types of individual constitutional appeals in foreign countries. There are direct and indirect manifestations of individual constitutional appeals, and the article analyzes several types of the above-mentioned manifestations of appeals of citizens and legal entities to the constitutional judicial body. In countries where the types of individual constitutional appeals are theoretically disclosed and centralized or scattered constitutional control is established, the level of effectiveness of individual constitutional appeals and the shortcomings of the types of appeals are analyzed in detail. In addition, the article theoretically reveals in which types of individual constitutional appeals the fundamental rights of citizens and legal entities are effectively protected and restored by the constitutional judicial body. It also provides a comparative and legal analysis of what types of individual constitutional appeals work best in countries with the same type of constitutional control, and in what forms the rights and interests of citizens and legal entities continue to be violated. At the end of the article there is a conclusion on the theoretical and comparative-legal analysis.
