Abstract

The article discusses the foreign experience of conducting mediation procedures in resolving family disputes and conflicts, analyzes the laws on mediation in foreign countries and the circumstances of their adoption. It is noted that the introduction of mediation today is a natural trend, a means of resolving family disputes and achieving a more acceptable outcome for the parties to the conflict. As well as the experience of mediation of foreign countries in resolving disputes between the parties in an acceptable form, is studied as a factor that directly alleviates the burden on the judiciary. The resolution of family disputes is a responsible task, therefore, in most foreign countries, mediation laws provide for mediation first, and then in court. In some foreign countries, family disputes about who should have a child, the determination of common property and alimony must first go through mediation. In most foreign countries, mediation laws require the mediator to have professional qualifications, additional special training in family mediation, as well as a certain age and practical experience. In addition to the requirements for the professional qualities of a mediator, there is also a list of requirements for the ethical qualities of a mediator. It is concluded that in the developed countries of the world the activities of the mediator are regulated by law and carried out on a professional and non-professional basis, however, in some countries, additional violations may be established in the legislation of the subjects. Existence of voluntary and obligatory types of mediation is analyzed. At the same time, as in Uzbekistan, professional mediators are often people with higher education or additional professional training.
