HISTORY AND MODERN FUNCTIONS OF PATENT LAW: THE EXPERIENCE OF EUROPE AND THE UNITED STATES

This article analyzes the historical development stages of patent law, the key legal factors in its formation, and its functional significance in the modern era. In particular, the evolution of intellectual property protection mechanisms is examined using the patent systems of European countries and the USA as an example. The aim of the research is to analyze the historical evolution of patent law, reveal its modern legal and economic functions, and develop scientifically grounded proposals and recommendations for the development of the national system based on advanced foreign experience. Additionally, the article scientifically examines the role of the patent system in stimulating innovation, monopoly issues, the impact of judicial practice, and regulatory issues. A comparative analysis of international experience with national legislation was conducted, and proposals and recommendations aimed at improving Uzbekistan’s patent system were put forward. The results of the study are of scientific importance for the development and practical application of patent law.
