THEORETICAL AND LEGAL ANALYSIS OF THE INDEPENDENCE OF JUDGES AND GUARANTEES FOR ENSURING IT: ISSUES OF IMPROVEMENT

This article provides a detailed overview of the history of the formation of the judiciary, the legal nature of the concepts of judicial independence and guarantees for its provision, as well as the system of guarantees for judicial independence. Additionally, a comparative legal study of judicial independence guarantees was conducted using the experience of foreign countries, specifically the Republic of Kazakhstan. Comparative-legal, systematic analysis, historical and formal-legal methods were used in the research process. As a result, the differences between the institutional and personal types of judicial independence were identified, and the shortcomings of institutional, personal, procedural and material guarantees in the current system were shown. In particular, the lack of transparency in the selection process for judicial positions and the presence of cases of interference in the activities of judges in practice were analyzed. The article scientifically substantiates that it is impossible to build a rule-of-law state without adequately ensuring guarantees for the independence of judges.
