НЕЗАВИСИМОСТЬ СУДЕЙ И ТЕОРЕТИКО-ПРАВОВОЙ АНАЛИЗ ГАРАНТИЙ ЕЁ ОБЕСПЕЧЕНИЯ: ВОПРОСЫ СОВЕРШЕНСТВОВАНИЯ

В данной статье всесторонне освещаются история становления судебной власти, правовая природа понятий независимости судей и гарантий её обеспечения, а также система гарантий независимости судей. Кроме того, проведён сравнительно-правовой анализ гарантий независимости судей на примере опыта зарубежных государств, в частности Республики Казахстан. В ходе исследования использовались сравнительно-правовой, системно-аналитический, исторический и формально-юридический методы. В результате были выявлены различия между институциональной и личной независимостью судей, а также обозначены недостатки институциональных, личных, процессуальных и материальных гарантий, существующих в действующей системе. В частности, проанализированы недостаточная прозрачность процесса отбора на должность судьи и случаи вмешательства в деятельность судей, встречающиеся на практике. В статье научно обосновано, что без надлежащего обеспечения гарантий независимости судей невозможно построение правового государства.
