Abstract

The article examines the legal nature of an industrial design as an object of industrial property and proposes improvements to Article 8 of the Law of the Republic of Uzbekistan “On Inventions, Utility Models and Industrial Designs.” It addresses the problems of distinguishing industrial designs from works of applied art, as well as the conflation of visual design with its material embodiment. The dual functional and aesthetic nature of industrial designs is also explored. A comparative legal analysis is conducted of the legislation of the Republic of Uzbekistan and foreign approaches to the legal protection of industrial designs. The article substantiates the need to incorporate the concepts of “design” and “industrial or handicraft production” into the statutory definition. It proposes criteria for distinguishing objects of patent law from those protected by copyright, systematizes the types of industrial designs, and develops a revised version of Article 8 of the aforementioned Law.
