REGRESSION IS AN IMPORTANT AND NECESSARY STRUCTURAL ELEMENT OF THE SYSTEM OF CIVIL LAW LIABILITY

This article analyzes the role of tort and recourse obligations in the system of non-contractual obligations in civil law, their interconnection, and their legal nature. The obligation of recourse is defined as a secondary, but independent institution of tort law, and its main features and regulation in Article 1001 of the Civil Code of the Republic of Uzbekistan are considered. Also, in practice, the problems related to the invalidity of transactions due to non-compliance with the requirements of public procurement and the recovery of damage caused to the state budget from officials in the manner of recourse are highlighted. The conclusion substantiates the need to develop clarifications from the Plenum of the Supreme Court to form a unified judicial practice.
