ТЕОРЕТИКО-ПРАВОВОЙ АНАЛИЗ СУЩНОСТИ, КЛАССИФИКАЦИИ И ФУНКЦИЙ ПРАВ РЕБЁНКА В КОНТЕКСТЕ АЛЬТЕРНАТИВНОЙ ОПЕКИ

Статья посвящена комплексному теоретико-правовому анализу прав ребёнка как самостоятельной межотраслевой категории международного и национального права. Раскрываются понятие, сущность и ключевые характеристики прав ребёнка – универсальность, неотчуждаемость, специфичность, комплексность и международно-правовая обусловленность, – формирующие особый правовой режим защиты детства. На основе Конвенции ООН о правах ребёнка 1989 года и законодательства Республики Узбекистан, включая Закон «О гарантиях прав ребёнка» и Семейный кодекс, проводится систематизация существующих классификационных подходов: от модели 3Ps (Provision – Participation – Protection) и её модификаций до деления прав на личные неимущественные и имущественные. Особое внимание уделено функциональному назначению прав ребёнка: выделяются и характеризуются защитная, развивающая, социализирующая, гарантирующая, коммуникативная и превентивная функции в их взаимосвязи. Центральным авторским вкладом является обоснование расширенной модели 3P + G, в которой четвёртый компонент – институциональные гарантии (Guarantees) – включает процессуальные механизмы защиты, право ребёнка на независимое представительство и систему постоянного мониторинга условий опеки. Предлагаемая модель обосновывается применительно к ситуациям альтернативной опеки, где повышенная уязвимость ребёнка, лишённого родительского попечения, объективно требует институционального усиления существующих гарантий.
