КОНТЕНТ В СОЦИАЛЬНЫХ СЕТЯХ КАК ПРОИЗВЕДЕНИЕ

Настоящая статья посвящена определению условий признания контента произведением как объектом авторского права. Предметом исследования выступает правовая природа контента в социальных сетях как потенциального объекта авторско-правовой охраны. Цель исследования состоит в разработке теоретических критериев правовой охраны цифрового контента. Актуальность темы обусловлена ростом числа пользователей социальных сетей и расширением масштабов цифрового творчества. В статье рассматривается проблема отсутствия универсальных критериев оригинальности и творческого характера произведения. На основе методов сравнительного анализа, теоретического осмысления и обобщения обоснована необходимость применения презумпции наличия творческого характера произведения при минимальном творческом вкладе автора. По результатам исследования сделан вывод о необходимости адаптации института авторского права к условиям цифровой среды. Полученные результаты могут быть использованы при совершенствовании законодательства об авторском праве, а также в дальнейших научных исследованиях в области интеллектуальной собственности.
